From all records I have from VA I went from 163.6 lbs. to 180.4 lbs. in the time period the VA is referencing to, which is a net gain of 16.8 lbs. This weight gain, provided by VA documentation, is in direct conflict with the VA’s assumption that I have “lost significant weight” and "this weight loss is evidence of a drug addiction or abuse".

 

 As is it would seem me pointing this out is making a big deal out of a small mistake. There is always more….

---Pg91 “In 2009, he would have stomach problems, and now he dose not drink.” ---Not only did I taper back and quit drinking well before that, also was rated for stomach problems before 2008. I was complaining that the VA medication was useless and I spent more out of pocket for OTC medications for a service connected, not drinking connected, disability rating.

---Pg84 “calls frequently for pharmacy refills.” --- See Narcotic Medications for full rebuttal.

---Pg90 “Description of Activates and Leisure Pursuits:  He typically spends his days taking pain pills…” --- Not exactly a “Leisure Pursuit, but for the lies the VA was conjuring it fit a lot better saying such.

---Pg99,100 “…vomiting 3-5x a day causing dental problems and even reported spitting pieces of teeth out. (Dental problems can be a sign of methamphetamine dependence.) --- Also a sign that you may need a dentist. I was supposed to have teeth pulled well before my Iraq deployment, and with no money post Army and the VA unwilling to provide assistance, decay does what it does best. I have had dental problems for years, not something that suddenly arose after my service that may be a sign of drug abuse.

---Pg99,100“RECREATION/LEISURE: He typically spends his days taking pain pills…” --- Again, not fun for me. Necessity… and all medications were provided by the VA at that.

---Pg101 “His history of alcohol and drug abuse could account for possible lack of motivation.” --- Like the majority of Highschoolers, I was around stuff and experimented to certain extents (never “hard drugs”), and then I moved on. I made more money working before I joined the Military than my time in it. “Lack of motivation”, more like lack of imagination on the VA’s part when coming up with this malarkey.

---Pg102 “…the question of financial problems may be related to due to his reported history of cannabis abuse and suspicion of other drug use.” --- See Cannabis. Also being disabled, receiving no benefits and being buried in medical bills were the reasons for financial strife’s. Instead of taking some responsibility for our suffering the VA unduly turns it all on us to help support their lies and misinformation.

---Pg117-118, 119 “As far as medical problems are concerned, degenerative disc disease of thoracic spine is his main problem for which he is taking morphine and hydrocodone. His pain is out of proportion to the underlying pathology, etiology of his sever pain cannot be explained based on physical and MRI findings. Extent of disease in spine should not render him unemployable…definitely employable as far as medical conditions are concerned. Hiatal hernia and Cervical spine sprain do not cause any limitations in physical activity do not affect his employability. Etiology of nausea is probably related to narcotic medications…” --- This one was repeated. The VA took four years and a dozen denials before admitting it had made “grievous errors” as to my spinal injuries. Of course none of these speculations were ever amended or rectified in my files. It is still being used in my records to help them paint their picture of me.

---Pg56 “Also wants a stronger dose of Hydrocodone. Has had MRI’s of brain and entire spine. None positive” --- Used later as part of their “drug seeking” rational placed upon me. I also requested treatments, braces, alternative medications, quite a bit that wasn’t as important for them to focus on.

---Pg23 Metham[phetamine]: “Negative” --- It will take more extensive combing thru of my records, but any and all blood test done will say the same. Never.

This is just a sample of how the VA ran with it’s claim. More to come, but these sample contradictions detail how the VA had not just a mistake or a misinterpretation or two, but an entire multilevel system in place that was set to discredit me. It worked to, I lost support and didn’t know why until I had a copy of the VA records and saw the game they were playing with my family and my names integrity.
